Can an insurance agent make me back pay for Cobra coverage?

I left my company back in July, and I waited to be contacted about Cobra in order to elect for coverage.
I called my insurance company several times and was still covered for several months. I figured my company had paid forward already for insurance so I just wanted until I was notified that my insurance was terminated to look into Cobra.
I was finally notified last month that my insurance was terminated so I called my old employer’s HR to get Cobra information since none was ever sent to me.
They use a third party (insurance agent) to handle their health benefits.
After I signed the election papers, the insurance agent sends me an outline of payment, and it stated that I will need to pay almost $2000 to back pay from July (when I left my company)
I asked him why I had to pay so much when I still had coverage then and he said it was an “administrative error” that they had kept me on their health plan and that I needed to pay for it.

I spoke with my former HR dept and they told me that it was the agent’s error that I was still kept on insurance for those months and that they owed my [former]company money because he was still charging them for my insurance and they had already requested that he terminate my coverage when I left.

Now he wants me to pay for his ‘administrative error’ and is going to make my Cobra coverage start all the way back in July (when I still had my regular coverage) and I cannot afford-nor was I expecting this!
I just assumed my company had already paid and my insurance would be terminated when that pay period ended.

Either way I am now stuck without having health coverage if I don’t pay this obscene amount! (I obviously would have allocated my expenses differently if I had to make the Cobra payments back in July, I don’t have that much $$ now as I have not been working since I left)

Is this agency legally able to make me pay for their ‘administrative error’ or is there something I can do to get Cobra coverage?

Is this even lawful?

Any info would be greatly appreciated!

What should be Obama’s domestic priority unemployment or healthcare?

The Facts: Unemployment numbers stand at 9.8% and the real unemployment rate at 17%. The Obama team admit under estimating the severity of the recession after their predicted 8% unemployment cap was blown past. The Facts: Healthcare – The claim is 30 to 47 million uninsured in America. The current goal is to create a government run federal option coupled with insurance mandate, fines and new taxes. Now to be fair they don’t say “without healthcare” just uninsured because across this nation hospitals are required to taken in everybody regardless of insurance in emergency cases. There are public hospitals and free clinics, free medicine along with CHIPS, MEDICAID, & MEDICARE.

So should the Democrats in Congress and the President spend all their time trying to overhaul the health insurance industry or should they be trying to help private enterprise create real lasting jobs?

And to respond to anticipated answers:

If stimulus is so great and created so many jobs why does the unemployment continue to grow “at unexpected rates” and second many of these so called created jobs are temporary like the 35 hours of work done by 3,600 people in Oregon which then was claimed as jobs created on the Stimulus jobs number. Plus you have a lot of temporary summer jobs for college age kids that have been counted as full time permanent jobs in the stimulus jobs number.

Extending unemployment benefits is not the same as having a full time job with benefits and does not create jobs.

Increasing COBRA coverage does not create jobs.

Under the proposed health care reforms, what will happen premiums for those with HSAs?

I am an entrepreneur and use a HSA combined with a high-deductible insurance plan to cover my family of 4. So far, I have been satisfied with the plan. I have a $6,000 annual deductible (which is funded by tax-deductible contributions of up to $6,000 in my HSA) and pay $300/month in premiums. The total out of pocket is well below what I would have paid for comparable COBRA coverage and, I get to keep any of the unspent $6,000 at the end of the year. I haven’t been able to discern how the proposed healthcare reform legislation will impact HSA plan users. I have 3 specific questions:

1. Will the cost of my High Deductible Health Insurance Plan rise? Thankfully, my family is in good health and we are in the lowest risk tier that Anthem (VA) offers. If community rating is applied to these plans, how could my rates NOT increase?
2. Will I lose any of the tax advantages currently afforded HSAs?
3. Will the legislation eliminate or otherwise change HSAs in any way?

How will the proposed national health care reform affect the unemployed?

Although I believe that everybody should have access to medical coverage, I have a few specific questions regarding the proposed plan. I noticed that in the specifics, it stipulates that the uninsured will be subject to a 2.5% tax on their income as a penalty for not having health insurance. My husband belongs to a labor union that negotiates the specifics of his employer provided health care. One of the stipulations for health coverage is that he is required to work a mininum number of hours every month to be eligible for health insurance. During the winter months we often find ourselves without health insurance because the weather doesn’t allow for him to work the minimum number of hours required for coverage. That hasn’t been a problem, we just schedule our annual check-ups during the months that he is working. Our children are covered during the winter months through a subsidy insurance plan provided by our state that covers all children whose parents make less than $65k/year. The premium is $15 a month and all dr’s visits and prescriptions have a co-pay of $3. However, this plan doesn’t cover adults, and the Cobra continuation coverage premium is out of our reach. It’s $700 a month for medical-only coverage. That’s our mortgage payment and when we’re surviving on unemployment, there’s no extra money to pay for private health insurance. Our annual income also puts us just above the maximum income that is eligible for medicaid, not to mention we sort of take pride in the fact that we are able to survive without welfare.

Specifically, my question is: are the unemployed going to be penalized the 2.5%, and how will the proposed plan affect or work with state plans that are already in place?
We are among the many Americans who cannot afford the COBRA coverage, so we opt to go without health insurance during the months he is unemployed. When people are surviving on unemployment, they generally can’t afford added expenses in their budget.
